These are the terms and conditions that apply to transactions at a NVIDIA Store. Please remember by placing an order or making a purchase at a NVIDIA Store, you agree to the terms set forth below along with NVIDIA's Standard Sales Terms and Conditions and Privacy Policy.
Eligibility
Individuals eligible to purchase from the NVIDIA Education Store include faculty, staff, students and parents as follows:
K-12 Faculty/Staff- Any employee of a public or private K-12 institution in the United States (including Puerto Rico) and Canada is eligible, including home-school teachers. In addition, school board members who are currently serving as elected or appointed members are eligible. Parent Teacher Association (PTA) or Parent Teacher Organization (PTO) executives currently serving as elected or appointed officers are also eligible.
Higher Education Faculty/Staff/Students - Faculty and staff of Higher Education institutions in the United States and Canada; and students attending, or accepted into a Higher Education institution in the United States and Canada are eligible to purchase. Purchases from the NVIDIA Store are not for resale.
Parents - Parents purchasing on behalf of their child, who is a student currently attending or accepted into a public or private K-12 or Higher Education institution in the United States (including Puerto Rico) and Canada, are eligible to purchase.
Purchase Limits and Quantity
Faculty, Staff and Students purchasing from the NVIDIA Education Store may have limited quantities of items that they can purchase per academic school year. A maximum of one developer kit can be purchased per customer. Bulk orders of all products are not valid and may be cancelled.
Also, all products may not be available at student pricing and some limitations may apply. Offer applies only to Jetson TX2 Developer Kits. Some products are only available for higher education students, and may require additional student eligibility verification and confirmation at checkout to complete your order.
Finally, NVIDIA Store education offers are not valid on prior orders or purchases, and cannot be transferred or otherwise redeemed for cash or coupon code. In some cases, the student offers may not be combinable with other offers.
Pricing and Price Reductions/Corrections
With regards to pricing, NVIDIA reserves the right to change prices for products displayed at/on the NVIDIA Store at any time, and to correct pricing errors that may inadvertently occur.
The NVIDIA Store reserves the right at any time after receiving your order to accept or decline your order for any reason. If NVIDIA cancels an order after you have already been billed, NVIDIA will refund the billed amount.
No Resale; Consumers Only
The NVIDIA Store sells and ships products to end-user customers only. You may not purchase products at the NVIDIA Store for resale, and we reserve the right to refuse or cancel your order if we suspect you are doing so.
U.S. and Canada Sales Only
The NVIDIA Store education offer is valid only in the United States (including Puerto Rico) and Canada. Note that NVIDIA products may subject to U.S. and foreign export control laws and regulations and must be purchased, sold, exported, re-exported, transferred, and used in compliance with such export laws and regulations.
Audit Rights
NVIDIA may routinely audit the purchases of customers at the NVIDIA Store to insure that all purchase conditions have been observed. If NVIDIA discovers you have made a false representation of eligibility or that a customer does not meet the purchase conditions, you authorize NVIDIA:
- For credit card orders, to charge to your credit card the difference between the amount you paid for the delivered goods and the price that NVIDIA charged the general public for the same goods at the NVIDIA Store, in effect on the date that you place your order; and
- For Gift Card, cash, or other payment means, the NVIDIA Store will (a) invoice the difference between the amount that you paid for the products and the price that NVIDIA charged the general public for the same goods at the NVIDIA Store, payable in fifteen days from the date of the invoice, and (b), should you fail to pay the invoice when due, NVIDIA may institute legal action against you in a court of competent jurisdiction, with the prevailing party entitled to attorneys' fees.
