TERMS & CONDITIONS

  • By entering this Promotion, you agree to be bound by these Promotion Rules ("Rules”) and to comply with all applicable laws and regulations.
  • The entry period for this LUCKY DRAW begins at 12:00 a.m. Australian Eastern Standard (“AEST”) and New Zealand Eastern Standard Time (“NEST”), respectively for Australia and New Zealand (collectively to be one area), Taiwan, South Korea, Thailand, Indonesia, Philippines, Vietnam, Singapore and Malaysia on 8 October 2018 and ends at 11:59 p.m. AEST and NEST, respectively, on 18th November 2018 ("Entry Period”).
  • To be eligible to win a prize, each participant has to complete the following criteria:
    • Upload a clear photo of their authentic receipt from retailers/dealers purchased between 8th October 2018 to 18th November 2018;
    • Upload a photo of the serial number of the product box;
    • Key in the serial number of the purchases product and date of purchase; and Complete the Promotion entry form with valid contact details on the “Choose wisely and win it all. Buy GeForce GTX 1060 and above and you could win these limited FORTNITE prizes” promotional page.
  • By submitting the photo on to the entry page, you expressly agree that your name and uploaded photo may be posted publicly to the Promotion page and NVIDIA’s Facebook and consent to NVIDIA and NVIDIA affiliates' collection, processing and use of your personal information that you provide in connection with this Promotion (including, but not limited to, disclosure of your name and profile photo) and under the terms of NVIDIA's privacy policy, which can be accessed at http://www.geforce.com/privacy-policy.
  • The issue date of applicable authentic receipts should start 1st October 2018 to 18th November 2018. Photo submissions will be reviewed and approved by NVIDIA at NVIDIA’s sole discretion. NVIDIA reserves the right to reject any entry or Participant.
  • The prize winners will be draw from the entries between: prize winners from each country will be drawn out on 7th December 2018 from the Participants entering this Promotion between 8th October 2018 to 18th November 2018.
  • NVIDIA will notify all winners by email. Winners must confirm receipt of notice by return of the email, and complete, sign and return a winner release form and other requisite documents (if any) listed in NVIDIA’s email notice within 14 days after the announcement.
  • All prizes will be shipped or emailed to the winners after NVIDIA receives the winners’ confirmation email with all NVIDIA required document and information.

    • Only one entry per purchase. Multiple entries are not allowed for one purchase.

  • “The Promoter”: NVIDIA. The promotion is in no way promoted, endorsed or administered by, or associated with, Facebook.
  • Entry is only open to “Participants” who:
    • Have reached the age of majority in the Participants’ currently residing country. In the event the Participants have reached 13 years old but have not reached the age of majority in the Participants’ currently residing country, parental/guardian approval must have been obtained and such parental/guardian approval is valid conditioned upon the parent/guardian has read and consented to the Rules and Terms and Conditions. Children under 13 years old are not eligible to participate in the Promotion. No team entries and no corporate or institutional entries are permitted in this Promotion.
    • Currently residing in Australia, New Zealand, Taiwan, South Korea, Thailand, Indonesia, Philippines, Vietnam, Singapore and Malaysia.
  • Cost: There is no cost or fee of any kind is necessary to enter the Promotion.
  • Content of Entries: The Promoter reserves the right to reject any entry, including any entry deemed by the Promoter, in its sole discretion. Without limiting the Promoter’s discretion, entries must not include any content that:
    • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
    • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
    • is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted entries;
    • defames, misrepresents or contains disparaging remarks about other people or companies;
    • contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
    • contains celebrities and/or other public or private figures; living or dead, without permission;
    • contains 3rd party advertisement that is not NVIDIA and brand-related images or text communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
    • violates any law.
  • Winners for the prizes:
    • All eligible entries received during the Promotion Period will be reviewed and approved by NVIDIA and published publicly on NVIDIA Promotion page.
    • Prizes:
      • There will be allocated number of winners for each participating country as stated in the local promotional website.
      • Prize set (also known as Fortnite set) worth about US$40 consists the following:
        • Fornite E3 purple t-shirt
        • Fornite flat cap
        • Fornite recycle bag
        • Fortnite recycle plastic cup and straw
    • NVIDIA reserves the right to substitute a prize with another prize of the same value without prior notice to Participants. The announcement of the prize substitution will be posted on the Promotion page.
    • The winner of this Promotion is solely responsible for any and all applicable taxes and government charges that result from his/her receipt and/or use of the prize. NVIDIA reserves the right to withhold and deduct such taxes and charges from the prize if and to the extent required by law.
    • There is no cash alternative to the stated prize, and the prize is non-transferable, non-exchangeable, and non-refundable.
  • Notification of Winners:
    • The Promoter will send an email to the winners, winner must send back a confirmation by return of the email within 14 working days after the winner announcement on the below:
      • Each winner is responsible for monitoring his or her email account for notification and receipt or other communications related to this Promotion.
      • Winners will be required to provide identification and relevant document, if any, to prove they comply with the Rules and the Terms & Conditions, including their age.
      • If a winner cannot be reached by the Promoter within ten (10) days using the email address provided at the time of entry, that winner shall forfeit the prize.
    • If a winner cannot be contacted or fails to claim the prize or to return the required winner documents within the specified time period, or if the prize is returned as undeliverable, or if a winner fails to comply with any of the provisions of these Rules, such winner will be considered to have forfeited the prize. In such case, NVIDIA reserves the right to draw reserve winners to substitute the disqualified winner(s) or not. NVIDIA’s decision relating to the result of Promotion shall be final. Translation of Rules: The English version of these Rules shall prevail if there are any conflicts or inconsistencies between the English version and any other non-English version of the Rules.

      • PERSONAL INFORMATION STATEMENTS

    • Prize winner’s personal information (“Personal Information”) will be collected to enable the Promoter to administer and promote this Promotion and its winners.
    • Participants should provide required information on the website. The Promoter will collect Participants’ personal information (including uploaded photos and receipts) and relevant information provided during the program (name, e-mail, city, phone number, etc.) for making public announcements, communication, subsequent works, records, and other purpose of marketing in this program and any advertising program in the future.
    • Participants agree and consent the Promoter to announce names of winners or other data on the website based on the purpose of this program. Each Participant can choose to provide relevant personal information and category or not. If Participant is reluctant to provide, that participant shall forfeit the qualification of this program.
    • Each Participant provides any personal information which shall be kept carefully by NVIDIA. In the period of personal information collection purpose, the period in contracts or relevant laws, or the storing period due to necessity for the performance of an official duty or fulfillment of a legal obligation, in accordance with NVIDIA Privacy Policy and relevant laws, the Promoter and its affiliated enterprises, co-marketing or co-promoting partners and their affiliated enterprises, other entity/company and its affiliated enterprise having business dealing with the Promoter, any necessary third party by legitimate obligation, or any other object with Participants’ consent in writing can use Participants’ personal information in or out of the eligible countries of this Promotion. According to NVIDIA Privacy Policy, Participants have rights of Access, Accuracy, Erasure, Restriction, Objection, Data portability, and Lodging a complaint with the appropriate supervisory authority.       • GENERAL TERMS AND CONDITIONS FOR “Purchase and Win”

    • Prizes and instructions on how to claim them form part of the Terms and Conditions set forth herein (“Terms and Conditions”). By participating in this “Purchase and Win” Promotion (“Promotion”), you (“You” or “Participant”) agree to these Terms and Conditions. Offer not valid in conjunction with any other offer. NVIDIA (“NVIDIA” or “the Promoter”) may at any time, at its sole discretion, revise the Rules, Terms and Conditions and other rules set forth by NVIDIA, including but not limited to the rules regarding selection of winners of the Promotion. Participants shall be bound by any and all such revisions.
    • Entry is only open to residents from Australia and New Zealand, Taiwan, Malaysia, Indonesia, Philippines, Vietnam, Singapore, Myanmar and Thailand. Participants who have reached 13 years old but have not reached the age of majority in the Participants’ currently residing country must have parental/guardian approval and such approval is valid only after the parent/guardian has read and consented to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor participating in this promotion. If the Prize is won by a person under the age of majority, the Prize will be awarded to the winner’s parent or guardian. Children under 13 years old are further subject to NVIDIA’s Kids Privacy Policy and are not eligible to participant in the Promotion. It is a condition of entry that the Participants read and agree to the Promoter’s privacy policy which can be found at here.
    • Employees of NVIDIA and its parent companies, affiliates, subsidiaries, advertising representatives and agencies, who are involved in the Promotion, and the immediate families of any of the foregoing persons, are NOT ELIGIBLE for this Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    • Incomplete entries will be disqualified. The Promoter will not be responsible for entries that are not received by the Promoter by the stipulated time, or that are not viewable or readable due to corruption, virus or other technical reasons. No responsibility is accepted for late, lost or misdirected entries.
    • The Promoter is not responsible for any incorrect or inaccurate information caused by the internet user or for any of the equipment or programming associated with or utilized in this Promotion or for any technical error or any combination thereof that may occur in the course of the administration of this Promotion, including any omission, interruption, deletion, defect, delay in operation or transmission communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or Promoter’s Website.
    • The Promoter reserves the right to amend these Terms and Conditions at its sole discretion anytime and without notice to Participants. Promoter’s rule interpretations and all judging decisions are final. Promoter has sole discretion in selection and rejection of winners of the Promotion. By entering this Promotion, the Participant agrees to be bound by the decisions made by NVIDIA and the Judges.
    • To the extent permitted by law, the Promoter, its officers, employees, contractors, representatives, agents, parent companies, subsidiaries and affiliated enterprises shall not be liable for any claims, losses (including loss of opportunity), damages, injuries, costs and expenses suffered sustained or incurred (including but not limited to indirect or consequential loss, or arising as a result of any negligent act or omission) as a result of, or arising out of, or in any way connected with:
      • this Promotion;
      • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
      • any theft, unauthorized access or third party interference;
      • any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter);
      • any manufacture defects, model incompatibility or restrictions imposed by the manufacturer;
      • any Prize that is late, lost, damaged or misdirected in transit; and/or
      • the use or attempted use of the Prize.
    • If the Prize consists of tickets for entertainment (such as concerts, festivals or similar types of events) and/or holidays/flights, there can be no claim on any form of compensation in case of cancellation. If the Prize includes travel/accommodation abroad for which a passport is required, the Participant must be in possession of a valid passport or local ID card to receive the Prize or the Prize is automatically forfeited.
    • Any tax liability arising as a result of accepting any Prize is the responsibility of the Prize winner.
    • The Participant must provide accurate, current and complete information when participating in the Promotion. The Promoter may request a winner, before presenting the Prize, to provide his/her identity and residence information previously provided by the Participant. If a Participant does not truthfully provide all requested Personal Information, the Promoter may determine that they are not eligible to win the Prize.
    • Participant acknowledges that the Promoter can rely on these Terms and Conditions and disqualify a Participant if the Promoter believes the Participant is not acting in conformity with the Terms and Conditions. Promoter may require the Participant to return a Prize or pay its equivalent value if Promoter learns of a Participant’s ineligibility or disqualification after awarding the Prize to such ineligible or disqualified Participant.
    • If for any reason the conduct or operation of this Promotion is interfered with or disrupted in any way (including but not limited to, vandalism, power failures, natural disasters, acts of God, governmental acts or orders or restrictions, local restrictions, civil unrest, strikes, computer bugs or viruses, fraud, tampering, technical failures or any other causes beyond the control of the Promoter), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion in whole or in part. Neither party shall be liable to the other party for damages or losses in this case. The Promoter assumes no responsibility for any incorrect or incomplete information which may be communicated in the course of administering this Promotion.
    • The Promoter reserves the right to terminate this Promotion if fraud, technical failures or any other factor beyond Promoter's reasonable control impairs the integrity of the Promotion as determined by the Promoter in its sole discretion. Online entries made with multiple e-mail addresses, under multiple identities or through the use of any other device or artifice to enter multiple times will be deemed invalid. If the winner is an online entrant, the winning online entry will be deemed to have been submitted by the authorized account holder of the e-mail address from which the entry was made. The authorized email account holder is deemed as the natural person who is assigned to an e-mail address by an internet access provider, service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. The Promoter shall not be responsible for incorrect or inaccurate transcription of entry information, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, inability to submit the online entry form, or any other error or malfunction, or any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in this promotion, or for late, lost, stolen, postage due, illegible or misdirected entries. If this Promotion or any web site associated therewith (or any portion thereof) becomes corrupted or otherwise does not permit entry in the Promotion, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by Participants, fraud, technical failures, or any other causes, in the Promoters' sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper operation of this Promotion, the Promoter reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this promotion or any portion thereof.     • The Promoter reserves the right to suspend or terminate the Promotion and / or amend the terms and conditions of the Promotion at any time without notice.
    • The Official Rules and Terms and Conditions are governed by and shall be construed in accordance with the laws of the State of Delaware, U.S.A., without giving effect to its conflicts of law rules. Each Participants hereby submits himself or herself to the exclusive jurisdiction of the state and federal courts sitting in Santa Clara, California, U.S.A.
