These are the terms and conditions that apply to transactions at the NVIDIA Store. By placing an order or making a purchase at the NVIDIA Store, you agree to the terms set forth below along with NVIDIA’s Standard Sales Terms and Conditions and Privacy Policy.
Eligibility
Individuals eligible to purchase from the NVIDIA Store are employees of startups who are members of the Inception Program for use by the startup organization. Purchases from the NVIDIA Store are not for resale.
Purchase Limits and Quantity
Inception members purchasing from the NVIDIA Store are limited to a maximum order of five units. Offer applies only to Jetson TX2 Developer Kits. This offer is not valid on prior orders or purchases, and cannot be transferred or otherwise redeemed for cash or coupon code.
Pricing and Price Reductions/Corrections
With regards to pricing, NVIDIA reserves the right to change prices for products displayed at/on the NVIDIA Store at any time, and to correct pricing errors that may inadvertently occur.
The NVIDIA Store reserves the right at any time after receiving your order to accept or decline your order for any reason. If NVIDIA cancels an order after you have already been billed, NVIDIA will refund the billed amount.
No Resale; Consumers Only
The NVIDIA Store sells and ships products to end-user customers only. You may not purchase products at the NVIDIA Store for resale, and we reserve the right to refuse or cancel your order if we suspect you are doing so.
U.S. and Canada Sales Only
The NVIDIA Store inception discount offer is valid only in the United States (including Puerto Rico) and Canada. Note that NVIDIA products may be subject to U.S. and foreign export control laws and regulations and must be purchased, sold, exported, re-exported, transferred, and used in compliance with such export laws and regulations.
Audit Rights
NVIDIA may routinely audit the purchases of customers at the NVIDIA Store to ensure that all purchase conditions have been observed. If NVIDIA discovers you have made a false representation of eligibility or that a customer does not meet the purchase conditions, you authorize NVIDIA to do the following:
- For credit card orders, to charge to your credit card the difference between the amount you paid for the delivered goods and the price that NVIDIA charged the general public for the same goods at the NVIDIA Store, in effect on the date that you place your order; and
- For Gift Card, cash, or other payment means, the NVIDIA Store will (a) invoice the difference between the amount that you paid for the products and the price that NVIDIA charged the general public for the same goods at the NVIDIA Store, payable in fifteen days from the date of the invoice, and (b), should you fail to pay the invoice when due, NVIDIA may institute legal action against you in a court of competent jurisdiction, with the prevailing party entitled to attorneys' fees.
