SERVICE-SPECIFIC TERMS FOR NVIDIA AIR

These Service-Specific Terms for NVIDIA Air are an exhibit to the NVIDIA Cloud Agreement (the “Agreement”) and are incorporated as an integral part of the Agreement.

1. Customer User Content. Customer agrees that it will not upload, store or share any Customer content comprised of or containing any personal information relating to an identifiable individual, financial, health or governmental information, or any other information which may be subject to data privacy or data security laws, rules, or regulations.

2. SLA. There is no SLA for NVIDIA Air. 

3. License Subscription Type. NVIDIA Air requires payment of Subscription fees in the form of credits provided on a per simulation compute hour basis, unless otherwise agreed to by the parties.  Customer must purchase NVIDIA credits in advance.  All such credits are nonrefundable, nontransferable and subject to expiration as specified in the NVIDIA entitlement certificate. Customer may apply credits towards use of the  NVIDIA Air at the rates made available by NVIDIA.  Any unused credits will automatically expire at the end of the applicable Subscription and will not have any  cash or refund value.
