Privacy Policy for NVIDIA Career Applicants

Thank you for your interest in joining our team. NVIDIA collects and processes personal information as a part of our career application process (“Recruiting Data”), and this Privacy Policy details what information we collect and how we use that information. This Privacy Policy applies only to our recruiting process. Please refer to our NVIDIA Privacy Policy for information on how we collect and process data for specific NVIDIA services and products.

NVIDIA determines the means and purposes for processing your Recruiting Data. If you are in the UK or European Economic Area (EEA), this means that the NVIDIA entity hiring in the respective region is the controller of such data.

How We Collect Recruiting Data

We collect Recruiting Data from:

  • You, when you provide your information with us, such as during the application process, including via our application portal, but also in other circumstances such as conferences, events, or through our online forms;
  • Public sources and social media such as LinkedIn;
  • NVIDIA employees who may have provided your information and.
  • Third parties such as conference organizers with whom you have shared your information knowing that it will be shared with NVIDIA.

How We Use, Store, and Share Recruiting Data

We use Recruiting Data consistent with applicable laws for recruitment, assessment, hiring, and to comply with recordkeeping and reporting requirements as well as to inform NVIDIA’s inclusive hiring efforts and programs. We do not sell personal information.

We have set out the categories of information we collect and how we use this information below. If you are in the UK or EEA, we also set out the lawful basis we rely upon to process your Recruiting Data.

  • Recruitment

    Personal contact information such as your name, phone number, email address, and mailing address. We use this information to communicate with you as part of the recruitment process. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for our legitimate interests, namely communicating with applicants and managing job applications for positions with NVIDIA.
    If you expressed interest in a particular field through one of our online forms, or to a recruiter at a conference or recruiting event or to us directly during a recruiting process, we will use contact information you provided to share relevant news or blog updates and to inform you when a position you may be interested in becomes available. The processing is necessary for our legitimate interests, namely to contact prospective candidates about available roles and related developments.
    Demographic information such as race/ethnicity (US only) and gender (male/female/decline to state). We use this information to collate demographic information on candidates to inform inclusive hiring and encourage a wide range of candidates to apply to NVIDIA. Where required by applicable law, we obtain your explicit consent to the processing of this personal information.

    Otherwise, this processing is necessary for our legitimate interests, namely to encourage an inclusive workforce and inform our recruitment processes.
  • Assessment

    Educational and professional background such as schools attended and degrees obtained, and internship and/or work history. We use this information to process and assess your application, including assessing your suitability for a role. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for our legitimate interests, namely assessing the suitability of candidates for roles at NVIDIA.
    We use this information to calculate proposed salary and assess eligibility for certain benefits. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for our legitimate interests, namely assessing and preparing job offers.
    We use this information to monitor and improve our application process. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for our legitimate interests, namely reviewing and updating our applications process.
    Other information provided by you or collected during the interview process (including notes made by us during the recruiting process), including feedback from interviews. We use this information to process and assess your application, including assessing your suitability for a role. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for our legitimate interests, namely assessing the suitability of candidates for roles at NVIDIA.
    We use this information to respond to your enquiries and to monitor and improve our application process. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for our legitimate interests, namely managing applications and improving the application process.
    Technical and security‑related identifiers (e.g., IP address, geolocation country code, autonomous system number, JA4 fingerprint) and similar identifiers associated with access to our career site.  We use this information for security and fraud or abuse monitoring.  The processing is necessary for our legitimate interests, namely to ensure the security and integrity of our services and IT systems, detect and prevent fraud and abuse.
  • Hiring

    Citizenship information (unless prohibited in the relevant jurisdiction), including government-issued identity numbers and visa or work permit information. We use this information to determine your eligibility to work. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for compliance with a legal obligation to which we are subject.
    We use this information to fulfil our obligations to relevant government authorities. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for compliance with a legal obligation to which we are subject.
    Results of background checks, which include identity verification, education history, and work history, to the extent such checks are permitted in the relevant jurisdiction. We use this information to assess your suitability for certain tasks, and to assess suitability for a role. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for our legitimate interests, namely managing our resources. 
    Results of criminal record checks, to the extent such checks are permitted in the relevant jurisdiction. We use this information to assess your suitability for certain tasks, and to assess suitability for a role. The processing is necessary for our legitimate interests, namely identifying and managing our risk exposure.

    Where relevant, the processing is necessary for reasons of substantial public interest on the basis of law applicable in the UK or EEA, namely the detection and prevention of unlawful acts.
    For certain positions such as those involving finance, financial credit checks, to the extent such checks are permitted in the relevant jurisdiction. We use this information to verify your suitability for certain tasks and suitability for a role, where the nature of the role requires additional background checks. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA or otherwise for our legitimate interests, namely risk and reputational management.
  • Ongoing Recruitment

    The above and all other information you may submit to us in connection with an application to NVIDIA. We use this information to open and maintain applicant records. The processing is necessary to take steps at your request prior to entering into a contract with NVIDIA.
    If you have applied for a specific position and were not selected, but we believe you are well suited for another open position, we will retain your data and may contact you and inform you of the other position. The processing is necessary for our legitimate interests, namely to contact prospective candidates about available roles.

Our Use of AI

When you apply for a job at NVIDIA, we use a tool that creates a “Match Score.” This score estimates how well your skills and experience fit a job based on your resume or application. We use Match Scores to find qualified candidates who might otherwise be overlooked. A low Match Score will not remove you from consideration.

Our hiring team reviews candidates using their own judgment. The Match Score is just one piece of information they may consider, but it does not control their decisions.

Transfer and Storage of Data

NVIDIA implements appropriate technical and organizational measures to protect your Recruiting Data against accidental or unlawful destruction, loss, change, or damage.

NVIDIA is located in California, and your information may be transferred to and stored in the U.S. To meet data protection requirements, we are a member of the EU-U.S. and Swiss-U.S. Data Privacy Frameworks, as well as the UK Extension to the EU-U.S. Data Privacy Framework (together referred to as “DPF”). This means we adhere to the Data Privacy Framework Principles of notice, choice, and accountability for onward transfer, security, data integrity, and purpose limitation, access, recourse, enforcement, and liability. We are responsible for the processing of Recruiting Data we receive under the DPF, or subsequently transfer to a third party acting as an agent on our behalf. We comply with the DPF for all onward transfers of Recruiting Data from the EEA (and as applicable, UK and Switzerland). We remain liable under the DPF if third-party agents that we engage to process Recruiting Data on our behalf do so in a manner inconsistent with the DPF, unless we prove that we are not responsible for the event giving rise to the damage.

NVIDIA has committed to cooperating with the panel established by the EU data protection authorities (DPAs), the Swiss Federal Data Protection and Information Commissioner (FDPIC), and the UK Information Commissioner’s Office (ICO) with regard to unresolved complaints concerning data transferred from the EU, Switzerland, and the UK.

Under certain conditions, you may invoke binding arbitration to resolve any complaint. We are subject to U.S. law, and we may be required to share data with U.S. law enforcement agencies. Recipients of Data

We may share your Recruiting Data with third-party vendors and other service providers that perform services for us or on our behalf, including to providers of human resources management and recruitment software. These recipients will use your Recruiting Data as processors only on our instructions. We may also disclose your Recruiting Data to third parties as required by law or if we reasonably believe that such action is necessary to: (a) comply with the law and the reasonable requests of law enforcement; (b) comply with legal process; (c) receive legal advice; (d) respond to requests from public or government authorities, including public or government authorities outside your country of residence; (e) detect and investigate security incidents, abuse, fraud, illegal activities, and breaches of agreements; or (f) exercise or protect the rights and property of NVIDIA, or the rights and property and personal safety of our team members or third parties.

These recipients include parties that are located in the United States. If you are in the UK or EEA, when we transfer Recruiting Data to these recipients, we will ensure that the recipient processes the Recruiting Data in a manner that conforms with the DPF principles by entering into agreements that contain appropriate safeguards, such as the EU Standard Contractual Clauses (as amended or supplemented to comply with requirements under applicable law in the UK and Switzerland), or verifying that the recipient is also certified to the DPF.

Data Retention

We retain Recruiting Data for as long as you continue to interact with us by applying for jobs or expressing interest in career opportunities. If you stop interacting with us, we will retain your Recruiting Data for no more than three years if you are in the UK or EEA, and no more than five years in all other regions, unless a shorter retention period is set to account for variation in local standards.

Sensitive Information

The following Recruiting Data we collect may be classified as “sensitive” under certain privacy laws (“sensitive information”): information relating to racial and ethnic origin.

We use this sensitive information for the purposes set forth in the How We Use, Store, and Share Recruiting Data section above.

We do not sell sensitive information, and we do not process or otherwise share sensitive information for the purpose of targeted advertising. However, subject to certain legal limitations and exceptions, you may be able to limit our processing of sensitive information (as described in the Your Rights and How to Exercise Them section below).

Your Rights and How to Exercise Them

Depending on your jurisdiction, and under certain circumstances, you may have the following rights with respect to your Recruiting Data. You can exercise any of these rights by contacting our Data Privacy Team at CandidatePrivacy@nvidia.com

  • Right to access. You have the right to access and review your personal information.
  • Right to take your data. You have the right to obtain a copy of your personal information.
  • Right to erasure. You have the right to request that we erase your personal information.
  • Right to restrict use. You have the right to request that we stop using your personal information for any purpose.
  • Right to correction. You have the right to request that any inaccuracies in your personal information be corrected or incomplete data be completed.
  • Right to limit use and disclosure of sensitive personal information. You have the right to direct us to limit the use of your sensitive personal information to certain purposes, including to perform the services reasonably expected.
  • Right to object. You also have a right to object to any processing based on our legitimate interests. There may, however, be compelling reasons for continuing to process your personal information, and we will assess and inform you if that is the case. 
  • Right to withdraw your consent. Where we rely on your consent to process your personal information, you have the right to withdraw your consent at any time.  
  • Right to lodge a complaint. If you feel we’ve failed in any way, you have the right to lodge a complaint with us, or with a data protection authority in your region. However, we encourage you to first reach out to us so that we can address your concerns together. 

You also have the right to not receive retaliatory or discriminatory treatment in connection with a request to exercise the above rights. However, please note that if the exercise of these rights limits our ability to process personal information, we may no longer be able to engage with you in the same manner.

Before processing your request, we will need to verify your identity. In order to verify your identity, we may at times need to request additional personal information from you, taking into consideration our relationship with you and the sensitivity of your request. In certain circumstances, we may decline a Privacy Rights request, particularly where we are unable to verify your identity.

Authorized Agents

In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf through the designated methods set forth above, where we can verify the authorized agent’s authority to act on your behalf. In order to verify the authorized agent’s authority, we generally require evidence of either (i) a valid power of attorney or (ii) a signed letter containing your name and contact information, the name and contact information of the authorized agent, and a statement of authorization for the request. Depending on the evidence provided, we may still need to separately reach out to you to confirm the authorized agent has permission to act on your behalf and to verify your identity in connection with the request.
